Utah Bars Claim Victory in Drink-Special Fight

Utah restaurant and bar owners are toasting the settlement of their lawsuit against the state's ban on drink specials.

The Utah Hospitality Association sued in federal court, claiming Utah's law prohibiting establishments from offering discounted drinks or happy hour violates the Sherman Act, which protects against anticompetitive conduct.

The lawsuit was dismissed this week.

Allen Whittle, the association's vice president and owner of Bogeys Social Club, says the state agreed to allow establishments to change their drink prices daily, but they're still not allowed to advertise them as specials.

Whittle says it's a partial victory.

Assistant Utah Attorney General Kyle Kaiser sees it differently. He says the state made no concessions, that daily drinks specials have always been allowed, and the association only won "peace of mind."
