A mentally ill man twice declared too sick to stand trial for the meat-cleaver killing of a New York City psychotherapist appears headed to court.

David Tarloff's lawyers said Wednesday they aren't challenging state doctors' June finding that the schizophrenic's condition has improved enough for him to stand trial.

The 44-year-old Tarloff is charged with murdering psychologist Kathryn Faughey (FAW'-hee) in 2008 after a robbery plot went astray. He plans an insanity defense.

A judge set a Jan. 7 trial date.

Tarloff was deemed mentally incompetent for trial for about a year after his arrest. Then he was found fit, but his condition deteriorated and he was declared incompetent again during jury selection in 2010.

Faughey's brother Michael said the family hopes to see a trial completed this time.
